1. Eligibility

To use the platform, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

  • Creating an Account: In order to launch a Campaign or make a contribution, you must create an account on Donate68.com. You agree to provide accurate, complete, and up-to-date information during registration and to update this information as necessary.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access to your account.

3. Use of the Platform

  • Launching a Campaign: Users may launch a Campaign to raise funds for personal, charitable, business, or other purposes. Campaign creators are responsible for providing accurate and truthful descriptions of their Campaigns.
  • Contributions: Contributors may make financial contributions to Campaigns via the payment methods available on the platform. Once a contribution is made, it is final and non-refundable, except as specified in these Terms.
  • Prohibited Uses: You may not use the platform for any illegal, fraudulent, or unethical activities. Specifically, you agree not to:
    • Violate any applicable law or regulation.
    • Mislead contributors or otherwise provide false or misleading information.
    • Engage in any activity that could harm the integrity of the platform.

4. Campaign Obligations

  • Fund Use: Campaign creators agree to use the funds raised for the specific purpose stated in their Campaign description. Any diversion of funds for a different purpose without clear communication and consent from contributors is prohibited.
  • Refunds: If a Campaign does not reach its funding goal or is canceled, we may return contributions to the contributors in accordance with our refund policy.
  • Campaign Updates: Campaign creators are required to provide regular updates to their backers and notify them of any changes to the use of funds or the status of the project.

5. Fees

  • Platform Fees: We charge a service fee for using our platform. The fee structure will be displayed at the time of creating a Campaign or making a contribution. Fees may vary based on the type of Campaign and payment method.
  • Payment Processing Fees: Contributions may also be subject to payment processing fees, which are typically deducted before the funds are disbursed to the Campaign creator.

6. Payment and Disbursement

  • Payment Methods: Contributions are processed via third-party payment processors. You agree to comply with the terms and conditions of any third-party services used for payment processing.
  • Fund Disbursement: If a Campaign successfully reaches its funding goal, we will disburse the raised funds to the Campaign creator, minus applicable fees. Disbursement is subject to verification of the Campaign and compliance with these Terms.

7. Intellectual Property

  • Ownership: You retain ownership of the content you submit to the platform, including images, videos, and text. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with our services.
  • Prohibited Content: You may not upload, post, or share any content that infringes on the intellectual property rights of others.

8. Privacy

Your use of our platform is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using our services, you consent to the collection and use of your data in accordance with our Privacy Policy.

9. Dispute Resolution

  • No Guarantee of Success: We do not guarantee that any Campaign will be funded, or that funds raised will be sufficient to complete the project.
  • Indirect Damages: To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

11. Termination

  • Termination by Us: We may suspend or terminate your access to the platform at our discretion, without notice, for violation of these Terms or for any other reason we deem appropriate.
  • Termination by You: You may terminate your account at any time by contacting us. Upon termination, you may still be liable for any outstanding obligations.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective when posted on the platform, and we will notify you of material changes via email or through the platform. Your continued use of the platform after any changes constitutes your acceptance of the updated Terms.
